MyPacer Client Waiver & Release of Liability

IMPORTANT: Please read this waiver carefully before participating in any activity facilitated through the MyPacer App. By signing below, you confirm that you understand and agree to all terms outlined herein.

1. Definitions

• “MyPacer” refers to the MyPacer App, the company that owns and operates it (MyPacer Pty Ltd), and its employees, contractors, representatives, agents, affiliates and partners.
• “Pacer” refers to the individual whom you book via the MyPacer platform to run alongside you and provide pacing support during a scheduled run.
• “Client” refers to you, the individual booking and participating in a paced run through the MyPacer platform.
• “Activity” refers to any run, meet-up, interaction or event facilitated via the MyPacer platform.

2. Assumption of Risk

I acknowledge and agree that participating in any Activity involves inherent risks, including but not limited to:
• Slips, falls, sprains, or impact with objects, vehicles, terrain or other people
• Overexertion, dehydration, heat stroke, or other physical conditions
• The unpredictable nature of public spaces and outdoor environments
• Meeting a pacer for the first time in a public setting

I voluntarily assume all such risks, whether known or unknown to me at this time, and understand that I am solely responsible for my own health, safety, and preparedness.

3. Medical Fitness and Condition

I confirm that:
• I am physically fit and capable of safely participating in running-based activity
• I have no known medical condition, injury or impairment that would affect my ability to safely take part in a run
• If I become aware of any condition or risk, I will immediately withdraw from the Activity and/or seek medical clearance before participating again

I understand that MyPacer and the pacer I am paired with are not medical professionals, and I will not rely on them for medical advice or emergency response.

4. Pacer Relationship

I acknowledge that:
• MyPacer pacers are not fitness coaches, personal trainers, or employees of MyPacer Pty Ltd
• Pacers are independent users of the platform providing pacing only, not performance guarantees or fitness advice
• MyPacer does not make any guarantees regarding a pacer’s background, performance, fitness level, or suitability

It is my responsibility to use reasonable judgment in meeting a pacer and to ensure my own personal safety during any Activity.

5. Release and Indemnity

To the fullest extent permitted by law, I hereby:
• Waive and release all claims against MyPacer Pty Ltd and any pacer I meet through the app for any injury, loss, or damage I may suffer in connection with my participation
• Indemnify and hold harmless MyPacer Pty Ltd and any associated pacers, employees, directors, contractors or agents from any claims, costs, or liabilities arising from my participation in any Activity

This release applies to all legal, equitable or statutory claims including negligence (excluding gross negligence or wilful misconduct), and binds my heirs, successors, executors, and personal representatives.

6. Photo and Media Consent (Optional)

I consent to MyPacer capturing and using photos or testimonials related to my use of the platform for marketing and promotional purposes. I waive any right to compensation or review in connection with such use.

7. General Terms

• I confirm I am over the age of 18. If under 18, a parent or guardian must sign below.
• I agree to comply with all reasonable safety instructions, terms of use, and conduct guidelines set by MyPacer Pty Ltd.
• I understand this waiver is valid for all current and future Activities unless revoked in writing.
