Welcome to MyPacer. By accessing our website (www.mypacer.app) or using our mobile application (the "Service"), you agree to be bound by these Terms and Conditions.

1. THE SERVICE

MyPacer is a marketplace platform operated by MyPacer Pty Ltd that connects independent running pacers ("Pacers") with individuals seeking running companionship or pace discipline ("Runners"). MyPacer Pty Ltd does not provide running services; it facilitates the connection between independent third parties.

2. ELIGIBILITY

You must be at least 18 years of age to create an account and use the Service. By using MyPacer, you represent and warrant that you meet this age requirement.

3. USER ACCOUNTS & VERIFICATION

• Users must provide accurate and complete information during registration.
• MyPacer utilizes third-party identity verification services to enhance community safety. However, MyPacer Pty Ltd does not guarantee the conduct, background, or suitability of any user. Users are encouraged to exercise caution and perform their own due diligence before meeting in person.

4. PAYMENTS & CANCELLATIONS

• Processing: All payments are processed securely via Stripe.
• Fees: MyPacer charges a platform fee on each transaction, which is transparently included in the total booking price.
• Cancellations:
  • Runner Cancellations: Cancellations made by a Runner within twelve (12) hours of the scheduled session start time may be subject to a late cancellation fee or forfeiture of the booking fee.
  • Pacer Cancellations: If a Pacer fails to attend a confirmed session, the Runner will receive a full refund.

5. HEALTH AND SAFETY (PHYSICAL ACTIVITY WAIVER)

IMPORTANT: Running is a physically demanding activity.

• By booking a session, the Runner warrants that they are in good health and have no medical condition that would make participation dangerous.
• Assumption of Risk: Users acknowledge that running involves inherent risks of injury.
• MyPacer Pty Ltd is not liable for any injury, health complication, or death arising from participation in a session.

We strongly recommend consulting a medical professional before beginning any high-intensity training program.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by Australian Consumer Law:

• MyPacer Pty Ltd is not responsible for the conduct (online or offline) of any User.
• MyPacer Pty Ltd is not liable for any direct, indirect, or consequential loss or damage arising from your use of the Service or your interactions with other Users.

7. GOVERNING LAW

These terms are governed by the laws of Queensland, Australia.
