MyPacer Pacer Waiver & Release of Liability

IMPORTANT: Please read this waiver carefully before offering pacing services through the MyPacer App. By signing below, you confirm that you understand and agree to all terms outlined herein.

1. Definitions

• “MyPacer” refers to the MyPacer App, the company that owns and operates it (MyPacer Pty Ltd), and its employees, contractors, representatives, agents, affiliates and partners.
• “Pacer” refers to you, the individual providing pacing services via the MyPacer platform.
• “Client” refers to the individual who books your pacing services through the MyPacer platform.
• “Activity” refers to any run, meet-up, interaction or event facilitated via the MyPacer platform.

2. Role and Responsibilities

I understand that:
• I am providing pacing services only, not coaching, instruction, or fitness advice
• I am not acting as a medical professional or personal trainer in any capacity
• I must act respectfully, responsibly, and professionally when interacting with clients
• I will arrive on time, communicate clearly, and ensure runs are conducted in safe, appropriate public areas

3. Medical Fitness and Conduct

I confirm that:
• I am physically fit and capable of safely participating in running-based activities
• I will not offer pacing services if I am injured, unwell, or unable to safely complete a run
• I will comply with any safety guidelines or conduct expectations provided by MyPacer Pty Ltd

4. Assumption of Risk and Indemnity

I acknowledge that participating in and offering pacing services involves risks including but not limited to:
• Injuries due to slips, falls, overexertion, or environmental hazards
• Interaction with clients I may not know personally
• Running in unpredictable public environments

To the fullest extent permitted by law, I:
• Accept all risks associated with providing pacing services
• Release and indemnify MyPacer Pty Ltd from any and all claims, liabilities, or costs resulting from my participation or provision of services
• Will not hold MyPacer Pty Ltd liable for any injury, damage, loss, or claim arising from my role as a pacer

5. Client Interactions

I acknowledge that:
• Clients are responsible for their own health, fitness, and preparedness
• I am not responsible for a client’s medical condition, injuries, or performance
• I will behave in a safe, respectful, and inclusive manner with all clients
• I will report any safety concerns or misconduct to MyPacer Pty Ltd

6. Photo and Media Consent (Optional)

I consent to MyPacer capturing and using photos or testimonials related to my use of the platform for marketing and promotional purposes. I waive any right to compensation or review in connection with such use.

• I confirm I am over the age of 18. If under 18, a parent or guardian must sign below.
• I understand that I am not an employee or agent of MyPacer Pty Ltd.
• I understand this waiver is valid for all current and future Activities unless revoked in writing.
